Terms of Service

These Terms govern your use of BidQuantum's bid analysis and advisory services. By placing an order or submitting documents to BidQuantum, you agree to these Terms. Please read them carefully.
1. Definitions
Services means the bid analysis, gap reporting, and advisory services provided by BidQuantum. Client means the individual or entity ordering Services. Submitted Data means all documents and information provided by the Client for analysis. Deliverables means the reports, analyses, and recommendations produced by BidQuantum. Fees means the charges payable for Services as stated on the website. Confidential Information means any non-public information disclosed by either party.
2. Services
BidQuantum provides bid analysis and advisory services only. Services are advisory in nature. BidQuantum does not guarantee any specific outcome, win rate, score improvement, or contract award. Final decisions regarding bid content and submission remain entirely with the Client.
3. Fees and Payment
Fees as stated on the website at time of order. Monthly retainers billed in advance. Late payments attract statutory interest at 8% above Bank of England base rate under the Late Payment of Commercial Debts (Interest) Act 1998.
4. Intellectual Property
Analysis reports are the intellectual property of BidQuantum until full payment is received, at which point a licence is granted for the Client's use in their own tender submissions. Clients may not resell, repackage, or represent BidQuantum's analysis as their own original work to third parties.
5. Confidentiality
Both parties agree to keep the other's confidential information confidential. This obligation survives termination of these Terms.
6. AI and External Support Disclosure
The Client acknowledges that BidQuantum uses AI-assisted analysis tools as part of its service. Some contracting authorities may ask whether AI tools or external bid support were used in preparing a tender response. The Client is responsible for answering any such questions honestly. BidQuantum accepts no liability arising from the Client's response to such disclosure questions.
7. Client Warranties
The Client warrants that: it has full authority to share all submitted documents with BidQuantum; submitted documents do not contain information subject to security classification, court orders, or confidentiality obligations that would prevent their disclosure to BidQuantum; it will comply with all applicable laws in using the Services.
8. Data Processing
BidQuantum processes submitted data solely for the purpose of delivering Services. All submitted documents are permanently deleted within 48 hours of delivering the completed report. BidQuantum does not use submitted data for training or improving AI systems.
9. Limitation of Liability
BidQuantum's total liability shall not exceed fees paid in the three preceding months. No liability for: loss of profits, loss of contract, loss of tender, indirect or consequential loss. Nothing excludes liability for death, personal injury, or fraud.
10. Termination
Monthly retainers: 30 days written notice by either party. Immediate termination for material breach. On termination, all submitted documents are deleted within 48 hours.
11. Governing Law
English law governs these Terms. Disputes are subject to the exclusive jurisdiction of the courts of England and Wales.
